On August 14, 2006 the final federal
regulations implementing Part B of the individuals with Disabilities
Education Improvement Act of 2004 (IDEA 2004) were published in the
Federal Register.

Part B of IDEA 2004 covers
school-aged children.

The process of amending federal
regulations began on December 3 2004 when President Bush signed into law
the IDEA 2004, reauthorizing IDEA and aligning the law with the goals and
purpose of No Child Left Behind.

Following the IDEA's reauthorization,
the U.S. Department of Education's Office of Special Education and
Rehabilitative Services (OSERS) solicited ideas for draft regulations to
implement the law. Beginning in January 2005, a series of public meetings
was held across the country. On June 21, 2005 the U.S. Department of
Education published draft federal regulations. The Department held a
second series of public meeting on the proposed regulations in the summer
2005. More than 5000 people responded and provided comments,
suggestions, or input to the U.S. Department of Education.

Final regulations are effective 60
calendar days from the date of publication (or October 14, 2006).
